This data protection declaration gives you an insight into the processing of your data at Formalactis. It applies to all websites, apps and other services and facilities offered by Formalactis.

How to read this data processing statement: We offer you different ways to read this data processing statement. In this section, first of all, you will find some basic information. Then we have divided this data processing statement into chapters according to the topics of interest to you. If you are already an "expert", you can now consult the individual chapters directly in this section.

We have preceded each chapter with a short introductory text. In it we briefly summarize the content of the chapter. If you want to have a quick overview of all data processing, we recommend reading the introductory texts. Where possible we have given up references in the text. This way you will receive full information in whatever chapter you are in.   1. What data is processed by Formalactis?

Formalactis offers several services that you can use in different ways. Depending on whether you contact us online, on the phone, in person or otherwise, different data from different sources come into play. Much of the data we process is communicated to us by you when you use our services, for example when you get in contact with us and register with us with your name, email address or address. We receive però also technical data on the equipment and on the’access data which are automatically collected during the’interaction with our services. These may refer to the type of equipment you use. We collect additional data on the basis of analyses that we carry out (e.g. in the context of market research or customer evaluations). If we combine personal data with anonymised data, all data in this data set applies as personal data. If we delete personal data from a data set or a personal information about you, the remaining data from this data set no longer counts as personal data. This procedure is called anonymisation. In principle, if we ask you to provide certain personal information, you can of course refuse to do so. You decide what information you wish to give us. This is possible for you; we will not be able to offer you the services you want or we will not be able to offer them to you in the best possible way. 1.1. Profile data

Profile data are personal and demographic data about yourself (so-called basic data) and your individual interests that you provide us with when registering a customer account. Profile data includes, for example:

  • your preferences, e.g. about brands, product types or style;
  • demographic data such as gender, age; and place of residence.

The required data are usually your name, address and email address, as well as the password you have chosen. Your email address and password will constitute your login credentials.

For the use of services for a fee, with limited access or personalized may also be required additional mandatory data, such as your date of birth or title (for example "Mr / Mrs", in order to direct you to the purchase page of the Formalactis site corresponding to your gender).

Profile data may also contain additional data about yourself and your interests. These can be collected either as part of your registration for the service or at a later date. 1.3 Purchase data

If you order something from Formalactis, we collect your purchase data. The purchase data may, depending on the type of sale and processing status, include the following information:

  • order number;
  • details on purchased products;
  • data on the means of payment;
  • supply and billing addresses;
  • communications and messages in relation to purchases (e.g. declarations of withdrawal, complaints and communications to customer service);
  • status of delivery and payment, e.g. "Completed" or "Shipped".
  • status of return, e.g. "Successfully completed";
  • data on the third party service providers involved in the execution of the contract (in the case of mail order could be the shipping number of the courier service).

1.4 Payment data

We offer you payments by bank transfer that will be made only after the confirmation of the order by the staff Formalactis. We transmit to our payment management services only those data that are necessary to carry out the payment.

Payment details can be, for example:

  • billing addresses;
  • IBAN and BIC or account number and bank code;
  • solvency&agrave data;;

1.5 Interest data

During your interaction with our services, data arise that allow us to know the content, themes, products, product ranges or brands you are interested in. For example, from your purchase data, the content of your wish list. Così in the next search you make, we can show you the products that are probably most relevant to you first.

1.6 Communications, content of interviews

If you communicate with us or other users by telephone, mail, social media services, contact forms or otherwise about our products (e.g. product evaluations) or other topics, we will take note of the content of your communications.

In this case we will not transmit your communication, or we will transmit it only without your personal data, to the competent office, if your question can be processed in this way.

If you send us communications to other users via the spaces provided for this purpose (e.g. product evaluations), these may be published by us as part of our services.

For communication with customers and users Formalactis also uses social network offers such as Facebook, Instagram or Twitter. We use these communication platforms to offer you, in addition to our communication channels, further possibilities of contact and information. Please take into account that we do not have the possibility to influence the conditions of use of social networks and the services they offer and that we have a limited influence on their data processing. We therefore ask you to check carefully what personal data you send us via social networks. We have no opportunity to influence the behaviour of social network operators, other users or third parties who may collaborate with social network operators or use their services.

1.7 Social network data

Eventually social network functions are integrated in Formalactis services. These could be messaging services and so-called social plug-ins or social logins such as "Register via Facebook". If you activate or use these services and are a member of the respective social network, we receive data from the respective operators through which you may be identified. We normally receive the following data from social networks:

  • your public profile data deposited with the social network (e.g. name, profile);
  • data on the type of device used by you;
  • l’Profile ID at the respective social network (e.g. Facebook ID).

However, without your consent, we do not receive any data allowing us to identify you or to contact you from social network operators.

In relation to advertisingà through social network we usually receive only information related to the interest and general demographic data for the effectiveness of our ads. For example, a man residing in Berlin, between 25 and 34 years of age, with interest in clothing and shopping, clicked on a specific ad of ours. These data and ratings come from the respective social network operator.

1.8 Location data

For certain purposes, during the use of our services, we also collect the current location data of your device. In this context we use two different technologies.

If you have given your approval to the location services of your device in an app, website or other online service of Formalactis, Formalactis processes the location data collected from your device and made available to us to provide you with location related services.

If you allow a Formalactis app to access your device's location services, your location may be transmitted to us on a regular basis (e.g. even if you do not use the app at that time). This process (so-called geolocation) is used by us and many other online shops, for example, for fraud prevention to identify suspicious orders (in certain pu&ograve situations; it is suspicious if you transmit orders via your customer account from an IP address in a country from which you have never placed orders).

1.9 Photos and other personal content

With some of our specific applications for certain services you can share photos or other personal content with us or other users, communicate with us or other users or customize services (e.g. uploading a photo to your profile, using the photo search of the Formalactis app or if you communicate with a stylist).

1.10 Data for actions and d&rsquo surveys;opinion

If you take part in an offer offered by Formalactis (e.g. a prize game) or a survey (e.g. customer satisfaction surveys in market research), please provide your personal details.

For example, in a prize game we normally ask you for your name and email address so that we can contact you in case of a win and to ensure that each participant can only take part in the prize game once.

In some actions and investigations we can also ask you for further data. 1.11 Requests for employment

To receive and process requests for employment, the companies of the Formalactis group rely on the central management system of Formalactis SRL.

1.12 Device data and access

When using online and mobile &egrave services; it is inevitable that technical data is formed and processed in order to make the functions available and view the content offered on your device. We define this data category as "device and access data". Device and access data is formed during every use of an online and mobile service. It makes no difference who is the provider of this service. Device data and access data are formed during the use of the device:

  • websites;
  • app;
  • newsletter email (i.e. when your newsletter interaction is detected);
  • services based on’location.

Formalactis collects device data and access to online and mobile services offered by Formalactis itself (e.g. Formalactis shop). In addition, Formalactis can also collect device data and access to online and mobile services offered by other companies if they are partners of Formalactis or if they participate in the same online advertising networks (e.g. the "Google advertising network").

Appliance and access data includes the following categories:

  • general information about the device, such as device type, operating system version, configuration settings (e.g. language settings, system permissions), internet connection settings (e.g. mobile network name, speed, connection speed) and the apps used (e.g. name and version of the app).
  • IDs, such as session IDs, cookie IDs, unique device serial numbers (e.g. Google advertising ID, Apple Ad-ID), account IDs of third-party providers (as far as you use social plug-ins or social-login) and other common Internet technologies, in order to recognize your web browser, your device or a specific app installation.

Example

If you activate the push communication service of a’Formalactis application, for l’identification is given to you in randomly generated and unique push-ID. We then transmit the push-ID together with the push communication directed to you to the push-server, so that it can address it to the right device, i.e. your device.

  • Access data that apps and web browsers automatically transmit to every online access on web servers and databases (as part of the so-called HTTP-request). This is standardised information about the required contents (e.g. name and file type of a file retrieved) as well as further information about the access to the server (e.g. amount of data transmitted and error codes), your device (e.g. device type, operating system, software versions, device identifications, IP address, the page you have previously visited and the time of access).
  1. Personalized services

The development and provision of functionalities and personalized services has the highest priority for us. Regardless of the location, time and type of equipment used, we offer you an individual shopping experience and an offer tailored to your individual interests. The processing of your data for the customization of our services at Formalactis è an integral part of the services.

Examples

  • If you create a wish list while on the go with the Formalactis app, you can open it and edit it later on the Formalactis website.
  • If you search for a product on the Formalactis webpage we store the search data. In this way, during subsequent searches on the website or in the Formalactis app, we can first show you the results that are probably more relevant for you.
  • If you place a product in your shopping cart, we can advise you, based on your previous orders and returns, to choose the right size.
  • If you have ordered a newsletter, we can present you with products that match your previous orders.

2.1 What are personalised services?

By means of personalized services we can offer you better services, moreù practical and moreù safe. For this purpose we use the data stored about you to draw conclusions about your needs and interests. On this basis, we can offer you more interesting, more interesting, more convenient and more secure content tailored to your needs and interests. Of course, you still have access to all content. By means of personalisation, you will see more and more content that is of interest to you or content that is presented specifically for you (e.g. in the form of individual product recommendations).

2.2 Why do I need a customer account?

Most of our personalized services require the creation of a customer account, so that we can store the data we collect about you in a central location.

2.3 What data is stored in my customer account?

Your customer account stores data that we collect from your person, as well as your customer number (CustomerID). The customer &egrave number; a randomly generated sequence of numbers that does not contain any personal data. Your data is combined with your customer number so that it can be linked to your customer account. The customer number also serves as a pseudonym.

2.4 What data is used for customization?

The selection of customized content is made in principle on the basis of all data stored in your customer account.

If device and access data not stored in your customer account are used, they are only pseudonymized for the respective personalization and used for the duration of use (e.g. in relation to your customer number, not for your name or other immediately identifiable profile data).

Not are used:

  • solvency data;;
  • data for actions and d’

  • requests for employment;
  • communications (e.g. customer service).

2.5 Your possibilities of choice

You can view most of the data we have stored in your customer account at any time. If necessary, you can also change the data in your customer account and thus influence your personalisation, for example by informing us of your preferences.

As far as customization is based on device data and access, you can prevent the detection of this data by deactivating the detection of this data using tracking tools. In this case, keep in mind that you will receive fewer or no personalized services and support. Please also note that the data used for personalised services is also necessary for other purposes (including the provision of our services). The collection of data used for this purpose therefore does not end with deactivation.   1. About websites and apps

We use your data for the provision of Formalactis websites and apps. In addition to device and access data, which is formed during each use of these services, the type of data processed and the purpose of processing depend in particular on how you use the functions and services made available through our services. Device data and access

For each access to our servers and databases, device and access data are formed and recorded in so-called server-logfiles. At the end of the respective session, the IP address contained therein is anonymized at short notice, as soon as the storage is no longer necessary to maintain the functionality of the respective website.

As far as available and activated on your device, we also detect the identification code of your device (e.g. the so-called "Advertising ID", if you use an Android device, or the "Ad-ID", if you use an Apple device). This device code is issued by the manufacturer of your device's operating system and can be read and used by websites and apps to present content to you according to your usage habits. Login

For each user who registers for a customer account or other service we create a password-protected personal access. If you do not log out after logging in with your login credentials, you will automatically remain connected to most of our services. Depending on the type of service, a cookie or comparable technology is used for this purpose. This function allows you to use part of our services even without reconnecting each time. For security reasons you will be asked to enter your password again if, for example, you wish to change your profile data or place an order. Social Plug-in

Our services may contain social plug-ins ("plug-ins") from different social networks. With the help of these plug-ins you can, for example, share content or recommend certain products to others. Plug-ins are normally deactivated and therefore do not transmit any data. You can activate plug-ins by clicking on the corresponding button (e.g. "Activate social media"). With an additional click on the same button, the plug-in can be deactivated. If the plug-in is activated, your web browser establishes a direct connection to the respective social network. The content of the plug-in is transmitted directly from the social network to your web browser and from this browser to our website. With l’integration of the plug-in, the social network obtains l’information that you have called up the corresponding page on our website and canò it captures your device and access data. If you are connected to the social network, this can be combined with your account on the respective social network. Depending on the type of service, common tracking technologies using tracking pixels and identification cookies or comparable IDs (so-called tagging) are used. In addition, our advertising partners can also collect your device and access data to provide us with information about your interests and demographic data (e.g. age, gender, region) during your use of our services. What are cookies?

We use three categories of cookies for our services:

  • Marketing Cookies ("Tracking-Cookie"): these cookies contain identifiers and collect device and access data in order to adapt the advertisementà customized on the Formalactis website to your individual interests. Our advertising partners, who operate online advertising networks, also collect device and access data on our websites. Services based on location.

The functions of some of our apps use the location services of your device to detect location data. System authorizations

For certain functions, our apps must access certain interfaces and data on your device. Depending on the operating system you use, ci&ograve requires specific authorization. Below we explain which authorisations (as far as they are relevant for the processing of your data) our apps may require and for what kind of functions they are required. The authorization settings can be changed at any time in the system settings of your device.

  • Location services / Location data: L’authorization to’access to the location services of your device è necessary for an app to access the location detected by your device. If you do not allow such access, the display of services according to the location may not be possible or only to a limited extent.
  • Messages / Push-Messages: L’authorization è necessary for l’use of push services. In some devices l’authorization è activated as standard for all apps.
  • Access to stored photos: L’authorization è necessary for an app to access stored photos (read access) and photos created by the app to be stored (write access).
  • Camera: L’authorization è necessary for an app to use the camera function of your device, to take photos or read QR codes. The respective app will only access the camera if you have called up a corresponding app function.
  • Call up mobile data (iOS) or call up access to all networks and network connections (Android): During use or l’installation of some apps, these permissions are required to allow the respective app to transmit data via the internet connection of your device (via WiFi or data connection). This authorization may be necessary to transmit the data you enter into the app, e.g. in the context of a search on our servers.
  • Delete or edit contents of USB flash drives/SD cards and read contents of USB flash drives/SD cards: These authorizations are necessary to allow the respective app to store data in the memory or in an additional memory used by your device and to retrieve them when necessary. The respective app reads only the data that has been stored in connection with the use of this app.

  1. Newsletter

We offer you various newsletter services. You will receive information on the topics covered in the individual newsletters and other alerts when you register for the newsletter service. For example, you will only receive the newsletter if you are a member of our newsletter list. During the use of our newsletter we also collect device and access data.

4.1 How do I register?

We use the so-called double opt-in or single opt-in procedure (depending on the country) to send our newsletters with registration requirement (like the Formalactis newsletters). This means that we only send you a newsletter after you have expressly authorized us to activate the newsletter service. If a double opt-in procedure is required in your country, you must also confirm that the email address you have provided is yours. For this purpose we will send you a confirmation email with which we ask you to confirm, by clicking on a link contained in the email, that you are the owner of the B&B; email address communicated to us. It is possible that we may waive this measure if you have already confirmed to us that you are the owner of the shop by clicking on a link contained in the email.

4.2 Cancellation

If you do not want to receive our newsletter at a later date, you can object at any time without having to pay us any more than the transmission costs at the basic rates. For this purpose, a communication in text form (e.g. email, fax or letter) to the Formalactis company responsible for the newsletter is sufficient. Of course, each edition of the newsletter also contains a link to unsubscribe from the newsletter.

 

4.3 What data is collected?

If you register for a newsletter, we automatically store your IP address and the date and time of registration and confirmation. In this way we can prove that you have actually registered and possibly identify unauthorized use of your email address.

We collect device and access data that are formed during your interaction with a newsletter. For this evaluation the newsletters contain references to image files that are stored on our server. We and our advertising partners use your data for advertising & personal data that is shown to you in Formalactis services and on the websites and apps of other providers. For this purpose we and our advertising partners use common internet technologies on the market. In this way we are able to advertise and collect information; more precisely and present to you as far as possible only advertisements and offers that are relevant to you. These reports are based on Formalactis' findings and also take into account summarized reports that we receive from our advertising partners.   1. When will my data be deleted?

We store your personal data for as long as it is necessary for the purposes of this data processing declaration, in particular for the fulfilment of our legal and contractual obligations. If necessary, we will also store your personal data for other purposes if and as long as the law permits us to do so; further storage for certain purposes, including defence against legal claims.

If you close your customer account, all data stored on you will be deleted. If the complete deletion of your data is not permitted or required by law, the data will be blocked for further processing.

The locking is done exemplarily in the following cases:

  • Your order and payment data and possibly other data are subject to various legal storage obligations, which may be those of the commercial code in the tax regulations. The law obliges us to keep the data for tax and economic checks for a period of ten years. We can only permanently delete the data in question when this period è expired.
