We would like to inform you that pursuant to art. 59 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the right of withdrawal è excluded in the following cases:
- order of tailor-made or clearly customized products;
- order of Products that are in danger of deteriorating or expiring rapidly;
- order of sealed Products that are not suitable to be returned for hygienic or health protection reasons or that have been opened after delivery.
With reference to the cases of exclusion of the withdrawal listed above, in particular, you are informed and accept that among the products that are likely to deteriorate or expire rapidly, those products of food nature, whose characteristics and quality are subject to alteration, even as a result of improper storage by you after delivery.
Pending the foregoing with regard to the exclusion of the right of withdrawal, you have the right to withdraw from the contract, without giving reasons, within 14 days after you or a third party appointed by you (i) received the product or (ii) in the case of purchase of moreù products delivered separately with a single order, received the last product.
To exercise the right of withdrawal, you must inform Formalactis S.r.l., with registered office in Naples, via Giacomo Puccini n. 16, of Your decision to withdraw from this contract by sending an explicit declarationstyle="color: #666666;"> a Formalactis S.r.l., in the modalityà preferred by You. To comply with the withdrawal period, è just send the communication relating to the’exercise the right of withdrawal before the expiry of the withdrawal period.
You will be responsible for any additional costs arising from the different means of payment chosen. The refund may be suspended until receipt of the goods or until your proof that you have returned the goods, whichever is earlier.
In the case of refunds before the order is processed, Formalactis SRL may withhold any costs for the management of the refund itself.
If you have received the product you are kindly requested to return it to Formalactis S.r.l., Via Somma n. 80, 80048 Sant’Anastasia (NA), without undue delay and in any case within 14 days from the day you communicated the withdrawal, using a carrier of your choice. This deadline è respected if you return the product before the expiry of the 14 day period. The costs of returning the goods will be charged to You.
You are only responsible for the decrease in value of the goods resulting from manipulation other than that necessary to establish the nature, characteristics and functioning of the goods.

If you have received an incorrect or damaged product, please send to Customer Service all’address – Seller's Customer Service, by e-mail all’address info@latteriasorrentina.com, indicating the defect and/or non-conformity; found, as well as the relevant documentation indicated in the return form itself (at least n. 1 (one) photograph of the Product, confirmation of the’order transmitted by us and/or the fiscal receipt).
Following receipt of the form and related documentation, we will evaluate the defects and non-conformities reported by you and decide whether to authorize the return of the Products by providing you with a feedback, containing the return code, by e-mail to the address provided by you during the registration process or during the transmission of the order.
L’authorization to return the Products will not be considered as a registry; in no way recognition of defects or non-conformities; the existence of which will have to be ascertained after the return.
The Products for which we have authorized the return must be returned by You, together with a copy of the return authorization notice bearing the “Return code”, within 14 (fourteen) days from the notification of the defect or non-conformity;, to the following address: Formalactis S.r.l., Via Somma n. 80, 80048 Sant’Anastasia (NA).
L’any refund of the price paid and the related shipping costs will be made, where possible, by the same means of payment used by You at the’act of purchase of the Product or, if You have selected the cash on delivery as the method of payment of the Product subject to withdrawal, in this case You will be asked to indicate the IBAN code of your bank account so that it can be used; Formalactis S. r.l. can make the above refund by bank transfer.
